美国专利审查§101(专利适格性)问题

一、背景 美国专利法中,专利适格性问题35 USC §101针对实用性驳回专利申请,其长期针对商业方法类,令申请人头痛的问题是计算机软件类专利申请经常被这个理由驳回。 Alice Corp(Alice Corp vs. CLS Bank)是2014年美国最高法院的一个判决,现在的审查标准取决于这个判决决定。 二、现有§101审查标准 第一步:权利要求是否在法律保护范围 MPEP 2106(Ⅰ):方法、机器、产品和物质组合物;如是,则进行第二步。 第二步:根据Alice案例,(Mayo 测试)分2A和2B两步 2A:判断该权利要求是否属于对法定例外(即自然法则、自然现象和抽象概念)的阐述或描述;如否,则进而进行B步骤。 2B:如果是抽象方法,是否有更多的要素 “判断该权利要求是否还记载显著多于法定例外的额外要素”,如果答案是肯定的,则权利要求具备可专利性;如果答案是否定的,则该权利要求不具备可专利性。 审查流程可以总结在以下流程图: 美国专利审查§101(专利适格性)问题 (长)8.25
